Medical malpractice liability and its consequences: A survey among AEU urologists | Actas Urológicas Españolas (English Edition)

A 1–5-Likert scale, was used in sections C2, 3, 4, 5, 6, 7 and 9." ] ] ] "textoCompleto" => "IntroductionAlthough urology is below average in terms of Medical Professional Liability (MPL) claims and indemnity payments in comparison to other specialties,<a class="elsevierStyleCrossRefs" href="#bib0110">1,2</a> worldwide urologists assume a considerable risk of facing a claim throughout their careers.<a class="elsevierStyleCrossRef" href="#bib0120">3</a> Thus, 10% of urologists in the U.S. receive one claim annually, and 2.5% of these are settled with paid indemnity.<a class="elsevierStyleCrossRef" href="#bib0115">2</a> In our context, urology is considered a specialty with a medium risk of receiving malpractice claims. However, a higher MPL rate has been recorded during the last 4 decades, with moderate but increasing size of indemnity payments.<a class="elsevierStyleCrossRefs" href="#bib0125">4,5</a>In face of this situation, there is general concern among the medical community, urology specialists and the Spanish Association of Urology (AEU). Receiving a claim is an extremely stressful experience, with significant impact on the life of practitioners at different levels.<a class="elsevierStyleCrossRefs" href="#bib0135">6–9</a>A survey was carried out among urologists in the U.S., aiming to analyze their experiences and responses when facing claims. It was found that more than 60% of the participants had received claims which had significantly affected their lives.<a class="elsevierStyleCrossRef" href="#bib0155">10</a> The objective of this study is to assess, in a similar way to the U.S. survey, the impact of MPL claims on Spanish urologists, evaluating their frequency and detecting areas of special risk, as well as analyzing their repercussions on patients and professionals. To our knowledge, this is the first survey of these characteristics carried out in Spain.MethodologyExperts in urologic MPL from the UAB chair of Professional Medical Responsibility and Legal Medicine designed a brief survey about urologic MPL, including aspects related to the incidence and characteristics of these claims (reason, route and resolution), as well as their consequences on professionals. This survey is shown in <a class="elsevierStyleCrossRef" href="#fig0005">Fig. 1</a>. The AEU and the Governing Board of the Research Foundation in Urology approved the completion of the survey, facilitating its implementation by means of the PIEM tool of the AEU-Foundation for Research in Urology. The online survey form was provided to all AEU associates in 2 periods (October–November 2018 and December 2018–February 2019). SPSS software (version 24.0) was used for data recording, and descriptive and bivariate analyses. Some preliminary results were presented in a plenary session of the LXXXIV National Congress of Urology of the AEU, held in Bilbao in June 2019.<elsevierMultimedia ident="fig0005"></elsevierMultimedia>ResultsA total of 202 responses were obtained (130 responses in the first period and 72 in the second period), assuming a response rate of 11.6% for all AEU associate urologists. The main characteristics of the surveyed urologists are shown in <a class="elsevierStyleCrossRef" href="#tbl0005">Table 1</a>. A percentage of 17.8 (36) respondents registered at least one claim. Seven urologists (3.47%) reported having received 2 claims and 8 urologists (3.96%) informed more than 2 claims. One respondent who reported having been claimed did not specify his/her sex; of the remaining 35, 77.14% (27) were male. There was a 19% women and 18.8% men who reported having had claims (no statistical significance (p=0.965)). The distribution by area of practice was as follows: 19.84% (26) to those working in the public service, 15.3% (2) of those working in the private sector and 15.68% (8) of those working in both areas; not statistically significant (p=0.7749). Of the 34 respondents who described the ailments or procedures involved in the claim, 21 corresponded to surgical acts (58.33%). <a class="elsevierStyleCrossRef" href="#tbl0010">Table 2</a> details the reasons for these claims.<elsevierMultimedia ident="tbl0005"></elsevierMultimedia><elsevierMultimedia ident="tbl0010"></elsevierMultimedia>Sixty-one percent of the cases were filed through the courts (27.8% through criminal proceedings [10], 22.2% contentious-administrative proceedings [8], 8.3% civil proceedings [3]), while 30.6% were filed out of court (11 cases). Five of the 24 cases that responded to this item reported that their case was deemed to have RPM (20.8%), as opposed to 18 cases of acquittal (75%). One urologist informed being unaware of the final resolution. Of the 5 urologists in whom MPL was considered, 4 were men, with a mean age of 53.2 years, 4 of them worked exclusively in the public sector and one case exclusively in the private sector. Two convictions were reported in the contentious-administrative jurisdiction (22% of contentious-administrative), one in the criminal (8% of criminal jurisdiction) and 2 in civil proceedings (33% of civil jurisdiction). The time elapsed from filing the claim to its resolution was more than 18 months (mean).Regarding the experience of the defendant, most of them consulted with an attorney (81.25%; 13 of the 16 respondents who answered this question). Only 2 of them responded that they had consulted a superior. Their opinions regarding institutional support are shown in <a class="elsevierStyleCrossRef" href="#tbl0015">Table 3</a>. Despite having been claimed, 93.8% of respondents did not believe that there was medical error (30 of the 32 that responded to this item) and 60.7% considered that the claim was not justified in any way (17/28 responses), compared to 14.3% (4) who accepted little justification, 3.6% (1) who credited some justification, 10.7% (3) who considered it quite justified and another 10.7% (3), who acknowledged it was completely justified.<elsevierMultimedia ident="tbl0015"></elsevierMultimedia>In relation to the impact of the claim on the professional, 88% of responses included emotional distress, reaching 100% when the claim was filed in the court. Respondents informed that emotional distress reached its maximum level at the beginning of the process and that it decreased until its resolution. Twenty-eight respondents (78%) stated that they had presented some symptoms after being sued. The most frequent ones being anxiety, irritability, feeling of frustration, anguish, fatigue and loss of self-esteem (arranged by frequency). Two cases out of 28 who answered this question (7.1%) acknowledged that they required psychological and psychiatric care, both of them were sued through criminal law.Doctor–patient relationship was considered to be affected in 67.9%, and 71.4% recognized that it had an influence on their professional career increasing their practice of defensive medicine. In fact, 8.3% reported having decided to stop performing complex surgeries. This percentage increased to 58.3% when only taking into account those who were sued after a surgical act. Finally, 6.7% of urologists considered retiring after facing a claim.DiscussionThe response rate obtained in the survey (11.6%) was similar to that achieved in the U.S. survey with similar characteristics (12%). In our opinion, this shows that Spanish urologists feel engaged with the problems derived from MPL claims, taking into account that our setting presents clearly lower litigation rates than the U.S. in terms of MPL claims.As expected, considering the different contexts already exposed, the survey among the members of the AEU reported a lower percentage of respondents (17.8% and 1.4 claims/urologist) than that reported in the U.S. survey (63% and 2.1 claims/urologist), as well as a percentage of cases with a lower MPL estimate (29.1 compared to 39.8% in the United States) and considerably smaller indemnity payment sizes (€50,000 vs. US$270,000).<a class="elsevierStyleCrossRef" href="#bib0155">10</a>However, the medical actions that motivated claims were similar in both contexts, corresponding to what is found in scientific literature.<a class="elsevierStyleCrossRefs" href="#bib0120">3–10</a> In the U.S. context, endourological surgery for lithiasis and oncological surgery had been reported to have high risk of claim,<a class="elsevierStyleCrossRef" href="#bib0160">11</a> with endourological procedures accounting for a higher percentage of compensation (40%), as well as higher amounts of indemnity payments. In their sample, the most frequent procedures were ureteral catheterization, the URS, percutaneous surgery, and lithotripsy.<a class="elsevierStyleCrossRef" href="#bib0165">12</a> On the other hand, the analysis of MPL claims related to urology in the United Kingdom highlights that the most frequently involved procedures were ureteroscopy, transurethral resection of the prostate, nephrectomy, vasectomy and ureteral catheterization.<a class="elsevierStyleCrossRef" href="#bib0170">13</a> Similar studies in France have shown that cancer surgery, prostate cancer and postoperative complications have the highest MPL rate, with a conviction rate of 27%.<a class="elsevierStyleCrossRef" href="#bib0175">14</a>In our setting, the highest incidence of claims for MPL is due to surgical complications and misdiagnosis or delayed diagnosis. The complications that occur during or as a consequence of surgical acts are the ones that usually generate more lawsuits.<a class="elsevierStyleCrossRef" href="#bib0180">15</a> The MPL rate described stands at 20.8%.<a class="elsevierStyleCrossRef" href="#bib0180">15</a> The disease areas which receive more claims also correspond to that reported in other countries: lithiasis (renal and ureteral) treatment and endourological procedures. Also prostate surgery, both in benign hyperplasia and cancer, and testicular disease such as torsion and vasectomy surgery.<a class="elsevierStyleCrossRefs" href="#bib0130">5,16,17</a> This survey shows the same tendency, showing a higher percentage of claims in testicular disease (7 cases, 20.58%), lithiasis (5 cases, 14.70%) and prostate, both benign hypertrophy and cancer (4 cases, 11.76%). The results of the survey show that most of the claims are related to surgical practice (58.33%), with a relevant mortality rate (6 cases, 17.65%).On the other hand, the results of the survey with regards to the health care sector in which MPL claims occur (mainly the public sector), repeated claims to the same professional, and the percentage of indemnity payments as resolutions, confirm the results of other studies in our area, carried out based on the analysis of MPL claims.<a class="elsevierStyleCrossRefs" href="#bib0180">15–18</a>The results of the survey also confirm that MPL claims are perceived as very stressful situations for physicians and may give rise to the so-called second victim phenomenon or, more specifically (regarding claims), to the clinical-judicial syndrome. The emotional distress caused by being sued can generate psychological and physical symptoms. Lawsuits can cause feelings of guilt, loss of control of the situation and concern about reputation, often motivated by uncertainty and unawareness during the process. Therefore, we must continue our efforts to encourage training in this area as well as in the creation of programs to deal with the consequences of this situation. Such high percentages of symptoms (88–100%) are especially relevant in the context of the poor institutional support described by our respondents. More than 50% of the participants reported having received institutional/colleague support. This should encourage institutions to develop specific programs (regarding approach or support) that may contribute to generate changes among their environments in this regard.<a class="elsevierStyleCrossRefs" href="#bib0135">6,7</a>Beyond professionals’ well-being, the results of this survey confirm that facing a medical malpractice claim significantly affects doctor-patient relationships and increases defensive medicine behaviors, which had been repeatedly mentioned before.<a class="elsevierStyleCrossRef" href="#bib0200">19</a>Carrying out a survey among urologists related to MPL and the way in which they approached this experience allows us to calibrate the level of affectation of the professionals involved. To our knowledge, urology is the first specialty that addresses and analyzes MPL and its impact on the specialty. The objective of this study was to assess the impact of these claims on Spanish urologists. MethodologyA survey on medical professional liability in urology was designed. The Spanish Association of Urology and the Urological Research Foundation approved the questionnaire, generated by the PIEM online tool. ResultsThe total number of responses obtained was 202 (11.6% rate), of which 25.24% reported having been claimed, 88% reported mood changes after being claimed, 100% in criminal proceedings. The level of emotional involvement reported was the highest at the beginning of the process and progressively decreasing until its resolution. An affected doctor–patient relationship was considered in 67.9% of cases and 71.4% acknowledged increased defensive medicine in their professional practice. A percentage of 6.7% considered leaving the profession. DiscussionThe response rate obtained and the medical acts motivating the claims were comparable to those obtained in a similar survey conducted in the United States. claims and indemnity payments in comparison to other specialties&#44;<a class="elsevierStyleCrossRefs" href="#bib0110"><span class="elsevierStyleSup">1&#44;2</span></a> worldwide urologists assume a considerable risk of facing a claim throughout their careers&#46;<a class="elsevierStyleCrossRef" href="#bib0120"><span class="elsevierStyleSup">3</span></a> Thus&#44; 10&#37; of urologists in the U&#46;S&#46; receive one claim annually&#44; and 2&#46;5&#37; of these are settled with paid indemnity&#46;<a class="elsevierStyleCrossRef" href="#bib0115"><span class="elsevierStyleSup">2</span></a> In our context&#44; urology is considered a specialty with a medium risk of receiving malpractice claims&#46; However&#44; a higher MPL rate has been recorded during the last 4 decades&#44; with moderate but increasing size of indemnity payments&#46;<a class="elsevierStyleCrossRefs" href="#bib0125"><span class="elsevierStyleSup">4&#44;5</span></a></p><p id="par0010" class="elsevierStylePara elsevierViewall">In face of this situation&#44; there is general concern among the medical community&#44; urology specialists and the Spanish Association of Urology &#40;AEU&#41;&#46; Receiving a claim is an extremely stressful experience&#44; with significant impact on the life of practitioners at different levels&#46;<a class="elsevierStyleCrossRefs" href="#bib0135"><span class="elsevierStyleSup">6&#8211;9</span></a></p><p id="par0015" class="elsevierStylePara elsevierViewall">A survey was carried out among urologists in the U&#46;S&#46;&#44; aiming to analyze their experiences and responses when facing claims&#46; It was found that more than 60&#37; of the participants had received claims which had significantly affected their lives&#46;<a class="elsevierStyleCrossRef" href="#bib0155"><span class="elsevierStyleSup">10</span></a> The objective of this study is to assess&#44; in a similar way to the U&#46;S&#46; survey&#44; the impact of MPL claims on Spanish urologists&#44; evaluating their frequency and detecting areas of special risk&#44; as well as analyzing their repercussions on patients and professionals&#46; To our knowledge&#44; this is the first survey of these characteristics carried out in Spain&#46;</p></span><span id="sec0010" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0070">Methodology</span><p id="par0020" class="elsevierStylePara elsevierViewall">Experts in urologic MPL from the UAB chair of Professional Medical Responsibility and Legal Medicine designed a brief survey about urologic MPL&#44; including aspects related to the incidence and characteristics of these claims &#40;reason&#44; route and resolution&#41;&#44; as well as their consequences on professionals&#46; This survey is shown in <a class="elsevierStyleCrossRef" href="#fig0005">Fig&#46; 1</a>&#46; The AEU and the Governing Board of the Research Foundation in Urology approved the completion of the survey&#44; facilitating its implementation by means of the PIEM tool of the AEU-Foundation for Research in Urology&#46; The online survey form was provided to all AEU associates in 2 periods &#40;October&#8211;November 2018 and December 2018&#8211;February 2019&#41;&#46; SPSS software &#40;version 24&#46;0&#41; was used for data recording&#44; and descriptive and bivariate analyses&#46; Some preliminary results were presented in a plenary session of the LXXXIV National Congress of Urology of the AEU&#44; held in Bilbao in June 2019&#46;</p><elsevierMultimedia ident="fig0005"></elsevierMultimedia></span><span id="sec0015" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0075">Results</span><p id="par0025" class="elsevierStylePara elsevierViewall">A total of 202 responses were obtained &#40;130 responses in the first period and 72 in the second period&#41;&#44; assuming a response rate of 11&#46;6&#37; for all AEU associate urologists&#46; The main characteristics of the surveyed urologists are shown in <a class="elsevierStyleCrossRef" href="#tbl0005">Table 1</a>&#46; A percentage of 17&#46;8 &#40;36&#41; respondents registered at least one claim&#46; Seven urologists &#40;3&#46;47&#37;&#41; reported having received 2 claims and 8 urologists &#40;3&#46;96&#37;&#41; informed more than 2 claims&#46; One respondent who reported having been claimed did not specify his&#47;her sex&#59; of the remaining 35&#44; 77&#46;14&#37; &#40;27&#41; were male&#46; There was a 19&#37; women and 18&#46;8&#37; men who reported having had claims &#40;no statistical significance &#40;<span class="elsevierStyleItalic">p</span><span class="elsevierStyleHsp" style=""></span>&#61;<span class="elsevierStyleHsp" style=""></span>0&#46;965&#41;&#41;&#46; The distribution by area of practice was as follows&#58; 19&#46;84&#37; &#40;26&#41; to those working in the public service&#44; 15&#46;3&#37; &#40;2&#41; of those working in the private sector and 15&#46;68&#37; &#40;8&#41; of those working in both areas&#59; not statistically significant &#40;<span class="elsevierStyleItalic">p</span><span class="elsevierStyleHsp" style=""></span>&#61;<span class="elsevierStyleHsp" style=""></span>0&#46;7749&#41;&#46; Of the 34 respondents who described the ailments or procedures involved in the claim&#44; 21 corresponded to surgical acts &#40;58&#46;33&#37;&#41;&#46; <a class="elsevierStyleCrossRef" href="#tbl0010">Table 2</a> details the reasons for these claims&#46;</p><elsevierMultimedia ident="tbl0005"></elsevierMultimedia><elsevierMultimedia ident="tbl0010"></elsevierMultimedia><p id="par0030" class="elsevierStylePara elsevierViewall">Sixty-one percent of the cases were filed through the courts &#40;27&#46;8&#37; through criminal proceedings &#91;10&#93;&#44; 22&#46;2&#37; contentious-administrative proceedings &#91;8&#93;&#44; 8&#46;3&#37; civil proceedings &#91;3&#93;&#41;&#44; while 30&#46;6&#37; were filed out of court &#40;11 cases&#41;&#46; Five of the 24 cases that responded to this item reported that their case was deemed to have RPM &#40;20&#46;8&#37;&#41;&#44; as opposed to 18 cases of acquittal &#40;75&#37;&#41;&#46; One urologist informed being unaware of the final resolution&#46; Of the 5 urologists in whom MPL was considered&#44; 4 were men&#44; with a mean age of 53&#46;2 years&#44; 4 of them worked exclusively in the public sector and one case exclusively in the private sector&#46; Two convictions were reported in the contentious-administrative jurisdiction &#40;22&#37; of contentious-administrative&#41;&#44; one in the criminal &#40;8&#37; of criminal jurisdiction&#41; and 2 in civil proceedings &#40;33&#37; of civil jurisdiction&#41;&#46; The time elapsed from filing the claim to its resolution was more than 18 months &#40;mean&#41;&#46;</p><p id="par0035" class="elsevierStylePara elsevierViewall">Regarding the experience of the defendant&#44; most of them consulted with an attorney &#40;81&#46;25&#37;&#59; 13 of the 16 respondents who answered this question&#41;&#46; Only 2 of them responded that they had consulted a superior&#46; Their opinions regarding institutional support are shown in <a class="elsevierStyleCrossRef" href="#tbl0015">Table 3</a>&#46; Despite having been claimed&#44; 93&#46;8&#37; of respondents did not believe that there was medical error &#40;30 of the 32 that responded to this item&#41; and 60&#46;7&#37; considered that the claim was not justified in any way &#40;17&#47;28 responses&#41;&#44; compared to 14&#46;3&#37; &#40;4&#41; who accepted little justification&#44; 3&#46;6&#37; &#40;1&#41; who credited some justification&#44; 10&#46;7&#37; &#40;3&#41; who considered it quite justified and another 10&#46;7&#37; &#40;3&#41;&#44; who acknowledged it was completely justified&#46;</p><elsevierMultimedia ident="tbl0015"></elsevierMultimedia><p id="par0040" class="elsevierStylePara elsevierViewall">In relation to the impact of the claim on the professional&#44; 88&#37; of responses included emotional distress&#44; reaching 100&#37; when the claim was filed in the court&#46; Respondents informed that emotional distress reached its maximum level at the beginning of the process and that it decreased until its resolution&#46; Twenty-eight respondents &#40;78&#37;&#41; stated that they had presented some symptoms after being sued&#46; The most frequent ones being anxiety&#44; irritability&#44; feeling of frustration&#44; anguish&#44; fatigue and loss of self-esteem &#40;arranged by frequency&#41;&#46; Two cases out of 28 who answered this question &#40;7&#46;1&#37;&#41; acknowledged that they required psychological and psychiatric care&#44; both of them were sued through criminal law&#46;</p><p id="par0045" class="elsevierStylePara elsevierViewall">Doctor&#8211;patient relationship was considered to be affected in 67&#46;9&#37;&#44; and 71&#46;4&#37; recognized that it had an influence on their professional career increasing their practice of defensive medicine&#46; In fact&#44; 8&#46;3&#37; reported having decided to stop performing complex surgeries&#46; This percentage increased to 58&#46;3&#37; when only taking into account those who were sued after a surgical act&#46; Finally&#44; 6&#46;7&#37; of urologists considered retiring after facing a claim&#46;</p></span><span id="sec0020" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0080">Discussion</span><p id="par0050" class="elsevierStylePara elsevierViewall">The response rate obtained in the survey &#40;11&#46;6&#37;&#41; was similar to that achieved in the U&#46;S&#46; survey with similar characteristics &#40;12&#37;&#41;&#46; In our opinion&#44; this shows that Spanish urologists feel engaged with the problems derived from MPL claims&#44; taking into account that our setting presents clearly lower litigation rates than the U&#46;S&#46; in terms of MPL claims&#46;</p><p id="par0055" class="elsevierStylePara elsevierViewall">As expected&#44; considering the different contexts already exposed&#44; the survey among the members of the AEU reported a lower percentage of respondents &#40;17&#46;8&#37; and 1&#46;4 claims&#47;urologist&#41; than that reported in the U&#46;S&#46; survey &#40;63&#37; and 2&#46;1 claims&#47;urologist&#41;&#44; as well as a percentage of cases with a lower MPL estimate &#40;29&#46;1 compared to 39&#46;8&#37; in the United States&#41; and considerably smaller indemnity payment sizes &#40;&#8364;50&#44;000 vs&#46; US&#36;270&#44;000&#41;&#46;<a class="elsevierStyleCrossRef" href="#bib0155"><span class="elsevierStyleSup">10</span></a></p><p id="par0060" class="elsevierStylePara elsevierViewall">However&#44; the medical actions that motivated claims were similar in both contexts&#44; corresponding to what is found in scientific literature&#46;<a class="elsevierStyleCrossRefs" href="#bib0120"><span class="elsevierStyleSup">3&#8211;10</span></a> In the U&#46;S&#46; context&#44; endourological surgery for lithiasis and oncological surgery had been reported to have high risk of claim&#44;<a class="elsevierStyleCrossRef" href="#bib0160"><span class="elsevierStyleSup">11</span></a> with endourological procedures accounting for a higher percentage of compensation &#40;40&#37;&#41;&#44; as well as higher amounts of indemnity payments&#46; In their sample&#44; the most frequent procedures were ureteral catheterization&#44; the URS&#44; percutaneous surgery&#44; and lithotripsy&#46;<a class="elsevierStyleCrossRef" href="#bib0165"><span class="elsevierStyleSup">12</span></a> On the other hand&#44; the analysis of MPL claims related to urology in the United Kingdom highlights that the most frequently involved procedures were ureteroscopy&#44; transurethral resection of the prostate&#44; nephrectomy&#44; vasectomy and ureteral catheterization&#46;<a class="elsevierStyleCrossRef" href="#bib0170"><span class="elsevierStyleSup">13</span></a> Similar studies in France have shown that cancer surgery&#44; prostate cancer and postoperative complications have the highest MPL rate&#44; with a conviction rate of 27&#37;&#46;<a class="elsevierStyleCrossRef" href="#bib0175"><span class="elsevierStyleSup">14</span></a></p><p id="par0065" class="elsevierStylePara elsevierViewall">In our setting&#44; the highest incidence of claims for MPL is due to surgical complications and misdiagnosis or delayed diagnosis&#46; The complications that occur during or as a consequence of surgical acts are the ones that usually generate more lawsuits&#46;<a class="elsevierStyleCrossRef" href="#bib0180"><span class="elsevierStyleSup">15</span></a> The MPL rate described stands at 20&#46;8&#37;&#46;<a class="elsevierStyleCrossRef" href="#bib0180"><span class="elsevierStyleSup">15</span></a> The disease areas which receive more claims also correspond to that reported in other countries&#58; lithiasis &#40;renal and ureteral&#41; treatment and endourological procedures&#46; Also prostate surgery&#44; both in benign hyperplasia and cancer&#44; and testicular disease such as torsion and vasectomy surgery&#46;<a class="elsevierStyleCrossRefs" href="#bib0130"><span class="elsevierStyleSup">5&#44;16&#44;17</span></a> This survey shows the same tendency&#44; showing a higher percentage of claims in testicular disease &#40;7 cases&#44; 20&#46;58&#37;&#41;&#44; lithiasis &#40;5 cases&#44; 14&#46;70&#37;&#41; and prostate&#44; both benign hypertrophy and cancer &#40;4 cases&#44; 11&#46;76&#37;&#41;&#46; The results of the survey show that most of the claims are related to surgical practice &#40;58&#46;33&#37;&#41;&#44; with a relevant mortality rate &#40;6 cases&#44; 17&#46;65&#37;&#41;&#46;</p><p id="par0070" class="elsevierStylePara elsevierViewall">On the other hand&#44; the results of the survey with regards to the health care sector in which MPL claims occur &#40;mainly the public sector&#41;&#44; repeated claims to the same professional&#44; and the percentage of indemnity payments as resolutions&#44; confirm the results of other studies in our area&#44; carried out based on the analysis of MPL claims&#46;<a class="elsevierStyleCrossRefs" href="#bib0180"><span class="elsevierStyleSup">15&#8211;18</span></a></p><p id="par0075" class="elsevierStylePara elsevierViewall">The results of the survey also confirm that MPL claims are perceived as very stressful situations for physicians and may give rise to the so-called second victim phenomenon or&#44; more specifically &#40;regarding claims&#41;&#44; to the clinical-judicial syndrome&#46; The emotional distress caused by being sued can generate psychological and physical symptoms&#46; Lawsuits can cause feelings of guilt&#44; loss of control of the situation and concern about reputation&#44; often motivated by uncertainty and unawareness during the process&#46; Therefore&#44; we must continue our efforts to encourage training in this area as well as in the creation of programs to deal with the consequences of this situation&#46; Such high percentages of symptoms &#40;88&#8211;100&#37;&#41; are especially relevant in the context of the poor institutional support described by our respondents&#46; More than 50&#37; of the participants reported having received institutional&#47;colleague support&#46; This should encourage institutions to develop specific programs &#40;regarding approach or support&#41; that may contribute to generate changes among their environments in this regard&#46;<a class="elsevierStyleCrossRefs" href="#bib0135"><span class="elsevierStyleSup">6&#44;7</span></a></p><p id="par0080" class="elsevierStylePara elsevierViewall">Beyond professionals&#8217; well-being&#44; the results of this survey confirm that facing a medical malpractice claim significantly affects doctor-patient relationships and increases defensive medicine behaviors&#44; which had been repeatedly mentioned before&#46;<a class="elsevierStyleCrossRef" href="#bib0200"><span class="elsevierStyleSup">19</span></a></p><p id="par0085" class="elsevierStylePara elsevierViewall">Carrying out a survey among urologists related to MPL and the way in which they approached this experience allows us to calibrate the level of affectation of the professionals involved&#46; To our knowledge&#44; urology is the first specialty that addresses and analyzes MPL and its impact on the specialty&#46; Research in the field of claims for alleged MPL and analysis of the areas of special litigation&#44; as is the case of the survey presented&#44; allow the establishment and implementation of actions that increase patient safety as well legal certainty of their urologists&#44; based on the actual situation&#46;<a class="elsevierStyleCrossRefs" href="#bib0205"><span class="elsevierStyleSup">20&#44;21</span></a> The repetition of the same survey within a few years should make it possible to assess the evolution of knowledge&#44;         "resumen" => "<span id="abst0025" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0035">Introducci&#243;n</span><p id="spar0025" class="elsevierStyleSimplePara elsevierViewall">La urolog&#237;a es una especialidad de riesgo medio de reclamaci&#243;n&#46; Recibir una reclamaci&#243;n por responsabilidad profesional m&#233;dica es una experiencia estresante con importantes repercusiones&#46; El objetivo de este estudio fue valorar el impacto de dichas reclamaciones sobre los ur&#243;logos espa&#241;oles&#46;</p></span> <span id="abst0030" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0040">Metodolog&#237;a</span><p id="spar0030" class="elsevierStyleSimplePara elsevierViewall">Se dise&#241;&#243; una encuesta sobre responsabilidad profesional m&#233;dica en urolog&#237;a&#46; La Asociaci&#243;n Espa&#241;ola de Urolog&#237;a y la Fundaci&#243;n para la Investigaci&#243;n en Urolog&#237;a aprobaron la encuesta&#44; facilitando su realizaci&#243;n mediante la herramienta PIEM por v&#237;a electr&#243;nica&#46;</p></span> <span id="abst0035" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0045">Resultados</span><p id="spar0035" class="elsevierStyleSimplePara elsevierViewall">Se obtuvieron 202 respuestas &#40;tasa de 11&#44;6&#37;&#41;&#46; El 25&#44;24&#37; reportaron haber sido reclamados en alguna ocasi&#243;n&#46; El 88&#37; refirieron una afectaci&#243;n del estado de &#225;nimo tras ser reclamados&#44; siendo del 100&#37; en la v&#237;a penal&#46; El grado de afectaci&#243;n emocional reportado fue m&#225;ximo en el inicio del proceso y fue decreciendo hasta su resoluci&#243;n&#46; El 67&#44;9&#37; consider&#243; una afectaci&#243;n en la relaci&#243;n m&#233;dico-paciente y un 71&#44;4&#37; reconocieron un cambio en el ejercicio de la profesi&#243;n&#44; aumentando la medicina defensiva&#46; Un 6&#44;7&#37; consider&#243; abandonar el ejercicio de la profesi&#243;n&#46;</p></span> <span id="abst0040" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0050">Discusi&#243;n</span><p id="spar0040" class="elsevierStyleSimplePara elsevierViewall">La tasa de respuesta obtenida y las actuaciones m&#233;dicas que motivan las reclamaciones fueron similares a las obtenidas en una encuesta similar realizada en Estados Unidos&#46; Se confirma que las reclamaciones son percibidas como situaciones muy estresantes&#44; pudiendo dar lugar al fen&#243;meno de la segunda v&#237;ctima o al s&#237;ndrome cl&#237;nico judicial&#44; por lo que deben destinarse esfuerzos a la formaci&#243;n en dicha materia y a programas que traten las consecuencias derivadas de dicha situaci&#243;n&#46;</p></span>"
