"figura" => array:1 [ 0 => array:4 [ "imagen" => "gr2.jpeg" "Alto" => 1616 "Ancho" => 2508 "Tamanyo" => 254591 ] ] "detalles" => array:1 [ 0 => array:3 [ "identificador" => "at0010" "detalle" => "Figure " "rol" => "short" ] ] "descripcion" => array:1 [ "en" => "<p id="spar0010" class="elsevierStyleSimplePara elsevierViewall">Distribution of insurance in the autonomous communities according to insurer.</p>" ] ] ] "textoCompleto" => "<span class="elsevierStyleSections"><span id="sec0005" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0005">Medical malpractice in the United States: an in-depth analysis of the phenomenon</span><p id="par0005" class="elsevierStylePara elsevierViewall">Medical professional liability (MPL) is a legal concept that dates back to 1728 BCE, when the code of Hammurabi already provided for faults and punishments for doctors in the exercise of their activity, consequences that could be purely pecuniary, similar to the current concept of civil liability, or more severe (typical of the period) such as physical punishment and even amputations.</p><p id="par0010" class="elsevierStylePara elsevierViewall">Beyond this initial historical note, there is no doubt that medicine has developed enormously over the past 100 years, to the benefit of society and patients. However, as Dr. Mixson pointed out at the annual meeting of the American College of Obstetrics and Gynaecologists in February 1986, it was a paradox that the increase in the effectiveness of medicine had led to an increase in the number of claims in the United States,<a class="elsevierStyleCrossRef" href="#bib0005"><span class="elsevierStyleSup">1</span></a> which began in the second half of the 20th century and reached levels that made MPL insurance unsustainable in up to 3 occasions and which have led to countless initiatives to solve them. These initiatives included the introduction of unique insurance tools, in some cases promoted by the doctors themselves, and the legislative reforms, commonly known as <span class="elsevierStyleItalic">tort reforms</span>,<a class="elsevierStyleCrossRef" href="#bib0010"><span class="elsevierStyleSup">2</span></a> in response to the difficulties of doctors to insure a growing claims risk, the lack of insurance coverage in some US states or the astronomical increases in the premiums for MPL insurance in some specialties, which led to a lack of these specialists<a class="elsevierStyleCrossRef" href="#bib0015"><span class="elsevierStyleSup">3</span></a> in some states. The situation was not always due to the changes in claims, but to a multitude of causes, as stated in the report by the US Congress.<a class="elsevierStyleCrossRef" href="#bib0020"><span class="elsevierStyleSup">4</span></a> The MPL insurance problem has been extensively analysed and documented from a multidisciplinary approach, which has led to the following probable causes: the changes in interest rates, the evolution of the capital markets, the regulatory standards of the insurance sector, capital and insurance capacity restrictions, underwriting cycles,<a class="elsevierStyleCrossRef" href="#bib0025"><span class="elsevierStyleSup">5</span></a> the dynamics of this type of claims, colloquially known as <span class="elsevierStyleItalic">long tail claims</span> and their effects on IBNR/IBNER provisions, as well as incentives and psychological factors.</p><p id="par0015" class="elsevierStylePara elsevierViewall">It is also necessary to highlight the peculiarities of the legal system itself,<a class="elsevierStyleCrossRef" href="#bib0030"><span class="elsevierStyleSup">6</span></a> which has encouraged frivolous claims, given the lack of limits on compensation, or the fees of lawyers, who often participate in the settlement of the claim and which, consequently, provide an incentive for sometimes disproportionate claims; incentives that the reforms of the legal system have sought to correct. All of these factors ultimately impacted on the health care system,<a class="elsevierStyleCrossRef" href="#bib0035"><span class="elsevierStyleSup">7</span></a> resulting in defensive medicine practices<a class="elsevierStyleCrossRef" href="#bib0040"><span class="elsevierStyleSup">8</span></a> that overwhelmed the system and reduced the availability of physicians in some states, as noted above. Following successive legal reforms that have stabilised claims, clinical safety and adverse event reporting initiatives<a class="elsevierStyleCrossRef" href="#bib0045"><span class="elsevierStyleSup">9</span></a> have been recognised as highly beneficial, with an abundant literature in the United States on MPL by specialty<a class="elsevierStyleCrossRef" href="#bib0050"><span class="elsevierStyleSup">10</span></a> and on the various medical acts.<a class="elsevierStyleCrossRef" href="#bib0055"><span class="elsevierStyleSup">11</span></a> Currently, and following the situation of skyrocketing prices in the United States, which is being replicated in developed countries, tensions are again being observed in the insurance of this risk in certain US states and for certain specialties. A recent report by the American Medical Association (2023)<a class="elsevierStyleCrossRef" href="#bib0060"><span class="elsevierStyleSup">12</span></a> highlights the uneven evolution of MPL premiums for insurance policies according to state and specialty. For obstetricians and gynaecologists in the period 2013–2022, in Florida (Miami-Dade County), premiums increased from $190,829 in 2013 to $226,224 in 2022, an increase of 18%, while in New Jersey premiums decreased from $109,189 to $90,749, a decrease of 1%. In Orange County, Los Angeles (California), the cost was stable, and the premium was the less expensive ($49,804). In contrast, it should be noted that the premium for an internist in Florida, Miami-Dude County, was $55,996 for the year 2022, $8274 in Orange (Los Angeles, California) and $15,900 in New Jersey (<a class="elsevierStyleCrossRef" href="#tbl0005">Table 1</a>). The high cost of premiums for obstetricians is likely to have contributed to a shortage of specialists in this field. Rulings such as the one that found a doctor liable for $97.4 million for brain damage to a newborn baby during childbirth have contributed to the increase in premiums.<a class="elsevierStyleCrossRef" href="#bib0065"><span class="elsevierStyleSup">13</span></a></p><elsevierMultimedia ident="tbl0005"></elsevierMultimedia></span><span id="sec0010" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0010">Europe, a disparate and poorly documented scenario</span><p id="par0020" class="elsevierStylePara elsevierViewall">Europe, on the other hand, has not been unaffected by the problem of MPL insurance, although this is a reality that has manifested itself later and with singularities that are different from what has happened in the United States due to the differences in the healthcare and legal systems. At the beginning of the 21st century, the report of the Standing Committee of the Hospitals of the European Union (2004)<a class="elsevierStyleCrossRef" href="#bib0070"><span class="elsevierStyleSup">14</span></a> warned of the increases in medical liability insurance premiums in some European Union countries and the Council of Europe echoed the difficulties in covering this risk in many member states in the face of the withdrawal of insurers from the market.<a class="elsevierStyleCrossRef" href="#bib0075"><span class="elsevierStyleSup">15</span></a> Likewise, the situation of MPL in Europe is not uniform or homogeneous. This is due to the socio-cultural and economic characteristics of the countries themselves. Northern European countries maintain a certain stability in insurance as a consequence of socio-cultural factors.<a class="elsevierStyleCrossRef" href="#bib0080"><span class="elsevierStyleSup">16</span></a> A recent study of surgical claims in Finland even found a decrease in such claims.<a class="elsevierStyleCrossRef" href="#bib0085"><span class="elsevierStyleSup">17</span></a> However, countries such as France, Germany and Italy suffer similar situations of increasing claims and problems of insurance supply due to the withdrawal of large insurers from this type of risk. The European Insurance and Reinsurance Federation<a class="elsevierStyleCrossRef" href="#bib0090"><span class="elsevierStyleSup">18</span></a> advocated the creation of public-private mechanisms for the assessment and coverage of MPL risks. One example is the mutual society Sham (Société Hospitalière d'Assurances Mutuelles) in France, founded in 1928 by the Fédération des Unions Hospitalières and currently present in Germany, Spain and Italy under the name of Relyens.</p></span><span id="sec0015" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0015">Spain: difficulties encountered by the Autonomous Communities in insuring medical professional liability risks</span><p id="par0025" class="elsevierStylePara elsevierViewall">Since the beginning of the 21st century, in line with the situation experienced in neighbouring countries, Spain has experienced repeated difficulties in insuring the liability of the Autonomous Communities and professionals, with unsuccessful tender procedures in the autonomous communities open tendering procedures and greater economic demands for insuring their risks. By way of illustration, it is worth mentioning that in 2019 the cost of insuring public healthcare was quantified at 75 million euros,<a class="elsevierStyleCrossRef" href="#bib0095"><span class="elsevierStyleSup">19</span></a> whereas currently the cost is around 111 million euros, according to the information published by the different healthcare administrations in their respective tenders, i.e. an increase of 48%. It should be noted that this amount (111 million euros) divided by the target population of each autonomous community represents a derisory average cost per inhabitant of 2.46 ;/year (<a class="elsevierStyleCrossRef" href="#fig0005">Fig. 1</a>). However, since 2008, the autonomous communities' health administrations have had obvious difficulties in insuring health liability in the face of budgetary difficulties and the rise in insurance company premiums in their respective tenders. Some peculiarities of health liability insurance by the autonomous community is the coexistence of 3 models of insurance: a first model in which the health administration insures civil and property liability, a second hybrid model in which 2 administrations only insure their civil <span class="elsevierStyleBold">or</span> property liability and self-insure for the risk not covered and, finally, a single administration that is self-insured and has no insurance and assumes in its budget the possible financial consequences of claims against the administration itself or its employees. At present, 2 insurers dominate the insurance market for this risk in the autonomous communities of Spain (<a class="elsevierStyleCrossRef" href="#fig0010">Fig. 2</a>), accounting for around half of the population covered, with large differences in the sums insured under the policies of the different Autonomous Communities in terms of limits per victim, annual limits, deductibles and other coverage (<a class="elsevierStyleCrossRef" href="#fig0015">Fig. 3</a>). It would be useful for the authorities and the respective administrations to analyse the reasons for this diverse situation in terms of coverage, as the market appears to be small and concentrated, with some apparent difficulties in terms of coverage and price tensions. There is less transparency on private health insurance and individual doctors at national level.</p><elsevierMultimedia ident="fig0005"></elsevierMultimedia><elsevierMultimedia ident="fig0010"></elsevierMultimedia><elsevierMultimedia ident="fig0015"></elsevierMultimedia></span><span id="sec0020" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0020">Catalonia: a unique model</span><p id="par0030" class="elsevierStylePara elsevierViewall">The insurance policy of the Consell de Col-legis de Metges de Catalunya (CCMC), a unique, singular and recognised model,<a class="elsevierStyleCrossRefs" href="#bib0100"><span class="elsevierStyleSup">20,21</span></a> has increased its premium by 55% in the renewal of the 2016–2022 model, currently insured by the mutual society Relyans, compared to the previous model 2012–2016, which was insured by Zurich, as a result of the uncertainty caused by the third additional provision of the reform of the system for the assessment of damages caused to persons in traffic accidents in Law 35/2015 of 22 September<a class="elsevierStyleCrossRef" href="#bib0110"><span class="elsevierStyleSup">22</span></a> "Compensation scale for damages caused by health care activities". This is due to the fact that the assessment system established by this law, which relates to damages caused by traffic accidents, will be used as a reference for a future regulation of the compensation scale for damages caused by health care activities, as stated in the third additional provision.</p><p id="par0035" class="elsevierStylePara elsevierViewall">This legislative initiative altered the insurance companies' perception of risk and led to the withdrawal of the leading companies in the insurance sector in Spain up to that time (Zurich and Mapfre) from the health liability market. This situation is similar to that which occurred in 2001, which led to the withdrawal from the market of Winterthur and Sant Paul Insurance España, leading companies in the medical-health insurance market in Spain, although the causes are different. It should be stressed that, despite these insurance tensions and the international and national precedents, it has been found that claims in Catalonia remain stable in terms of frequency and proportional to the population and health activity,<a class="elsevierStyleCrossRef" href="#bib0115"><span class="elsevierStyleSup">23</span></a> and that the CCMC's joint and several professional liability (PL) insurance model is sustainable and economically viable.<a class="elsevierStyleCrossRef" href="#bib0120"><span class="elsevierStyleSup">24</span></a> The delegation of the management, handling and defence of claims from the insurer to the policyholder, the CCMC, has contributed significantly to this. This has empowered the professionals themselves, the doctors, in the management of their own professional risks, which has benefited the different parties involved in the system, such as patients, medical centres and hospitals, the health system itself, the health and justice administration, and society as a whole, by enabling data analytics initiatives that have identified areas of risk and led to various clinical safety initiatives. The Catalan model, including the coordination between Catsalut and the CCMC, has made it possible to analyse the procedures with the highest risk of claims as a result of the cooperation between the entities.</p></span><span id="sec0025" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0025">Current situation</span><p id="par0040" class="elsevierStylePara elsevierViewall">Finally, it should be noted that markets go through cycles and MPL insurance is no exception to this multifactorial phenomenon, as mentioned in the first paragraph of this article. At present, the conditions for contracting MPL insurance are stabilising, after an enormously tough cycle following the withdrawal of generalist insurers from the MPL market and following clarification of the impact of the new traffic accident scale, which has resulted in greater legal certainty for insurers in assessing the risk of claims with greater certainty. However, it should be pointed out that this stabilisation of risk perception has not led to the progressive re-establishment of the insurance supply which, at present, is limited to the only two companies that insure the liability of healthcare professionals in the autonomous communities of Spain (Relyens and Berkshire) and with a residual participation of niche insurers for certain healthcare groups, medical societies, medical centres, etc. This scenario of limited insurance supply in Spain has meant that the economic conditions of the contracts remain unchanged and represent a risk for policyholders and insureds, given the asymmetry in the bargaining power of the various stakeholders. Therefore, clinical safety initiatives that promote the analysis, investigation and prevention of claims from a multidisciplinary perspective and incorporate disruptive innovations, such as artificial intelligence,<a class="elsevierStyleCrossRef" href="#bib0125"><span class="elsevierStyleSup">25</span></a> which have an impact on clinical safety and on the sustainability of the healthcare system itself and of the health liability insurance of the autonomous communities, hospitals and medical centres, and of the doctors themselves, take on greater importance and significance.</p></span><span id="sec0030" class="elsevierStyleSection elsevierViewall"><span class="elsevierStyleSectionTitle" id="sect0030">A bleak future</span><p id="par0045" class="elsevierStylePara elsevierViewall">Without these initiatives, the "stressed" health sector could be doomed to a new MPL insurance crisis in the next decade, in the face of variations in the exogenous or endogenous factors of the insurance or health system itself, which is in a balance that could be described as unstable, faced with the challenge of incorporating the <span class="elsevierStyleItalic">quintuple aim</span>, equity, in the improvement of the health system.<a class="elsevierStyleCrossRef" href="#bib0130"><span class="elsevierStyleSup">26</span></a> This is a healthcare management concept that derives from Berwick's initial model of the <span class="elsevierStyleItalic">triple aim</span>, introduced in 2008 by the Institute for Healthcare Improvement in the United States, and which recommended evaluating clinical projects on the basis of 3 objectives: improving the healthcare experience, improving population health and reducing the cost per capita. It then evolved to include the goal of professional satisfaction, the <span class="elsevierStyleItalic">quadruple aim</span>, a contribution made by Thomas Bodenheimer and Christine Sinsky of the Department of Family and Community Medicine at the University of California (San Francisco) in 2014, in response to the phenomenon of <span class="elsevierStyleItalic">burnout</span> among healthcare professionals, and finally in 2021 it will incorporate equity as an objective, the <span class="elsevierStyleItalic">quintuple aim</span>, in response to inequities in the healthcare system that emerged as a result of the covid-19 pandemic. As mentioned above when describing the situation in the United States, the rise in prices and the consequent tightening of monetary policy through the increase in interest rates promoted by the central banks affected the insurance sector in this line of business in different ways.
